Rates Rates are quoted on a weekly basis. Rates for each villa reflect the maximum occupancy - additional guests are subject to a per person / per day charge. Some places do not allow above the maximum stated. Rates are for 2000 and are occasionally, if rarely, subject to changes without prior notice. Your rental comes with the appliances and amenities as listed on the web page from which you first observed. Please go to that web page to fully familiarize yourself with the items included with the rental of your choice. Reservations & Prices for 2001 Yes! We are making reservations for 2001, and thanks for asking. Those bigger properties go fast so we are ready if you are. Our policy is this: we expect a 7% increase in price overall - although in isolated cases the price may jump higher and if we know this ahead of the increase, we will inform you. So....we will charge 2000 prices plus 7% unless otherwise stated to you when making your reservation. If the actual price is less than 7% your balance payments will be adjusted down and if it's more...yep...we will adjust upward and you will be required to pay the difference. Please keep in mind - we do not expect a big increase this year. This does not apply to any other charges associated with the rental. We do not guarantee prices for security, cleaning and other charges which are required by the owners as shown on the web pages. Reservations & Payments Payment of the applicable deposit amount, and a fully completed application must be received and approved by Ricardo Barraza & Associados , unless otherwise directed, before a confirmation will be issued. No grace periods are granted. Final payment, consisting of the remainder of the rental balance must be received by Ricardo Barraza & Associados. at least 60 days prior to guest arrival - except where the rules and obligations of deposit for the rental is specified differently. Please go to the web page to fully familiarize yourself with the amounts and dates required with this rental. Failure to make final payment on a timely basis will be subject to cancellation of the reservation.
Cancellations Refunds on cancellations for any reasons whatsoever are not provided beyond that which is covered in the cancellation policy as stated below. To protect against cancellation caused by unforeseen events, such as illness in your family, strikes, last minute problems and more, we STRONGLY recommend purchasing trip cancellation insurance to provide recourse for deposits and balances paid. The cost is surprisingly inexpensive for the comfort of assurance (starts ay 4% of your rental fee paid) and the company is quite professional and surprisingly liberal in allowances. We have found that there is about 1 - 2% rate of cancellation for unforseen incidents. An application should accompany this form. If not, please ask us for one and we will gladly drop one in the mail (sorry - this is limited to U.S. and Canadian residents only). You may also wish to purchase health insurance - you are not covered in Mexico
Our Cancellation Fee Policy: Security Deposits We do not collect or disperse security deposits. Security deposits are made payable directly to the owner or guardian of the rental and collection is made through the same. Ricardo Barraza & Associados. does not get involved with security deposits whatsoever. We can not be held liable for the loss of a security deposit for any reason whatsoever, nor can we be held liable in anyway due to a dispute arising from a security deposit. Additional Charges Rates do not include long distance or local calls where a telephone is provided, these are metered and payable to the owner separately from all other costs. Cleaning costs and heating, gas consumption are additional charges unless otherwise noted. Excessive cleaning upon departure (including but not limited to cleaning of upholstery, shampooing of the rugs, breakage, soiling or damage to the interior or exterior caused strictly by applicant) may be subject to further charges than what is expressed on the page. You are required to leave the villa as you found it. Again, make yourself fully familiar with the property page. Our Guarantee When you reserve and pay for a villa entirely through Ricardo Barraza & Associados.
we guarantee your villa will be available for you upon arrival in accordance to these
"Terms & Conditions." If for some unforseen reason the villa is not
available to you because it is either destroyed, uninhabitable due to structural damage or
essential equipment and fixtures such as heating, electrical systems, plumbing, hot water
being out of operation, or rented to another party by error, or is unihabitable because it
is not in working order per these "Terms & Conditions," Ricardo Barraza
& Associados will immediately attempt to find another villa of similar qualities, cost
and size. Failing this, a refund will be provided to the client. Liability For Amenities & Non Essential Items Ricardo Barraza & Associados will not be held liable nor provide refund, partial or
otherwise for amenities not provided for reasons outside of our control.
"Amenities" included for example are dishwasher, washing machines, private
telephones and incidental appliances. Amenities do not include heat, water, electricity.
The villa descriptions are accurate and updated as currently as possible given timely
updates from the owners of the villas. Ricardo Barraza & Associados will have sole
discretion to determine what amenities are considered to be "essential" to the
operation of the villas and apartments. General Liability Ricardo Barraza & Associados acts only as agent for the homeowners or their assigns for all accommodations listed. Under no circumstance shall Ricardo Barraza & Associados and its assigns be responsible for any personal loss by individuals renting the accommodations represented by Ricardo Barraza & Associados, expenses, claims, or injury, direct or indirect, caused or incurred before, during or after the party's stay in the accommodations represented by Ricardo Barraza & Associados. including attorney's fees.Ricardo Barraza & Associados and its assigns will not be held liable and will be otherwise rendered harmless for any events arising in law as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of accommodations or services provided by Ricardo Barraza & Associados. and its assigns for reasons of military action, revolutions and acts of GOD. You agree to idemnify and hold Ricardo Barraza & Associados. and its assigns harmless for any claims arising from a violation of the Terms & Conditions of this agreement or of any third party claims. Ricardo Barraza & Associados solely has the full discretion to refuse or discontinue service to any person or agent, and/or rescind any contract for accommodations of guest services. Ricardo Barraza & Associados and its assigns will not be held liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services as described in these "Terms & Conditions." These "Terms & Conditions" are the conditions by which will govern the reservations of all accommodations where Ricardo Barraza & Associados acts as the representative and agent, unless otherwise provided. Ricardo Barraza & Associados will have sole discretion to determine choice of forum and law provisions. Modification and Acknowledgement We may modify any of the items contained in these Terms & Conditions at any time
and in our sole discretion, by posting new Terms & Conditions on our site, as is done
from time to time. Any modification made to our Terms & Conditions will not effect
your rental, dates of arrival/departure and price quoted at time of the rental agreement
an invoice. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING OUR POSTING OF A NEW
AGREEMENT ON OUR SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE. Miscellaneous This Agreement will be governed by the laws of the Estados Unidos Mexicanos and the state of Quintana Roo, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in Cancun Quintana Roo, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. You acknowledge that you have agreed to be bound by these Terms and Conditions of this Agreement whether electronically or otherwise, you further acknowledge that you have received, understand and agreed to this Agreement. |
